Nature of the Platform

GrowAuction.in is an online information and advisory platform that aggregates, curates, and publishes details of bank-auctioned properties available from banks, financial institutions, ARCs, and NBFCs across India. The Platform is designed to assist investors and buyers in discovering, evaluating, and participating in e-auction opportunities.

Important Disclaimer: GrowAuction.in is an information aggregation and advisory platform. We are NOT an auctioneer, bank, financial institution, or SARFAESI-authorised agent. All auction processes, bidding, EMD collection, and property transfers are conducted directly by the respective bank or institution listed as the auctioning authority. We do not participate in, conduct, or guarantee the outcome of any auction.

Eligibility

To register and use the Platform, you must:

• Be at least 18 years of age
• Be legally competent to enter into a binding contract under the Indian Contract Act, 1872
• Not be barred from receiving services under applicable law
• Provide accurate, current, and complete information during registration

The Company reserves the right to refuse or revoke access to any user at its sole discretion.

User Registration and Account

• You may be required to create an account to access certain features of the Platform. You agree to provide truthful and accurate information and to update it promptly if it changes.
• You are solely responsible for maintaining the confidentiality of your login credentials. Any activity conducted under your account shall be deemed to have been conducted by you.
• You must notify us immediately at info.growauction@gmail.com in the event of any unauthorised access to or use of your account.
• The Company reserves the right to deactivate or terminate accounts found violation of these Terms or applicable law.

Property Listings and Information

• All property listings on GrowAuction.in are published in good faith based on information available from public auction notices, bank websites, and institutional communications. While we endeavour to maintain accuracy, we do not warrant or guarantee the completeness, currency, or accuracy of any listing.
• Reserve prices, EMD amounts, auction dates, and property details are subject to change without notice by the auctioning bank or institution. Users are strongly advised to verify all details independently from the originating bank before participating in any auction.
• GrowAuction.in does not assume any liability for losses arising from reliance on information published on the Platform without independent verification.

Advisory Services

• Any advisory, analytical, or educational content provided by GrowAuction.in — including but not limited to property insights, market analysis, legal overviews, and investment guidance — is for general informational purposes only and does not constitute financial, legal, or investment advice.
• Users are advised to conduct their own due diligence, engage independent legal counsel, and consult qualified financial advisors before making any investment decision based on information obtained through the Platform.
• The Company is not registered as a SEBI Investment Adviser, SEBI Research Analyst, or RERA Agent, and does not provide regulated advisory services under any such framework unless separately disclosed.

Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful, fraudulent, or unauthorised purpose
• Misrepresent your identity, qualifications, or authority
• Upload or transmit any harmful, defamatory, obscene, or infringing content
• Attempt to gain unauthorised access to the Platform's backend systems or databases
• Use bots, scrapers, or automated tools to extract data without written consent
• Circumvent, disable, or otherwise interfere with security features of the Platform
• Reproduce, republish, or commercially exploit any content from the Platform without permission
• Engage in any activity that disrupts the availability or performance of the Platform

Intellectual Property

• All content on GrowAuction.in — including but not limited to text, graphics, logos, icons, images, data compilations, and software — is the exclusive intellectual property of Growth Corner Advisor Private Limited or its licensors, and is protected under the Copyright Act, 1957, and other applicable intellectual property laws.
• Users may access and use Platform content solely for personal, non-commercial purposes. No content may be reproduced, distributed, sold, licensed, or otherwise exploited without the prior written consent of the Company.

Third-Party Services

GrowAuction.in may contain links to or integrations with third-party platforms, including bank e-auction portals, government websites, and other external services. The Company is not responsible for the content, availability, security, or privacy practices of such third-party platforms. Access to third-party sites is at your own risk.

Limitation of Liability

To the fullest extent permitted by applicable law:

• The Company provides the Platform on an 'as is' and 'as available' basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• The Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of (or inability to use) the Platform, including loss of profit, data, goodwill, or opportunity.
• The Company's aggregate liability to any user under these Terms shall not exceed the amount paid (if any) by such user for platform services in the three months preceding the event giving rise to such liability.

Indemnification

You agree to indemnify, defend, and hold harmless Growth Corner Advisor Private Limited, its directors, officers, employees, agents, and successors from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your breach of these Terms
• Any content you submit to the Platform
• Your violation of any applicable law or third-party rights

Modification of Terms

The Company reserves the right to modify these Terms at any time. Updated Terms will be published on the Website with a revised effective date. Continued use of the Platform following such publication constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

Termination

The Company may suspend or terminate your access to the Platform at any time, with or without notice, for any violation of these Terms, suspected fraudulent behaviour, or for any other reason at the Company's sole discretion. Upon termination, all rights granted to you under these Terms will immediately cease.

Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
• Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through mutual negotiation. If unresolved within 30 days, disputes shall be submitted to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator mutually appointed by the parties. The seat of arbitration shall be Mumbai, Maharashtra.
• Subject to the above, the courts of Mumbai, Maharashtra shall have exclusive jurisdiction over any legal proceedings related to these Terms.

Miscellaneous

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of future enforcement of that provision.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the use of the Platform.
• Assignment: The Company may assign its rights and obligations under these Terms to any successor entity without notice. You may not assign your rights under these Terms without prior written consent.
